(B) is made in a complaint or other document that is filed under seal in a lawsuit or other proceeding.
(ii) Notwithstanding any other provision of this Agreement, if Executive files a lawsuit for retaliation by Playa Management for reporting a suspected violation of law, Executive may disclose the Playa Managements trade secrets to Executives attorney and use the trade secret information in the court proceeding if Executive:
(A) files any document containing the trade secret under seal; and
(B) does not disclose the trade secret, except pursuant to court order.
(e) Communications with Government Agencies. Nothing in this Agreement or any other agreement between Playa Management and Executive or any policy of Playa Management:
(i) prohibits Executive from communicating with the Equal Employment Opportunity Commission, the National Labor Relations Board, the Occupational Health and Safety Administration, the Securities and Exchange Commission, or any other government agency (each a Government Agency) about a potential violation of the law;
(ii) limits Executives ability, without notice to or approval from Playa Management:
(iii) restricts Executives right to receive a reward or incentive for information provided to a Government Agency.
(f) Return of Proprietary Information. Executive acknowledges that all the Proprietary Information pre-existing, used or generated during the course of his employment by Playa Management is the property of Playa Management and the Playa Affiliates, as the case may be, and Executive holds and uses such as a trustee for Playa Management or the Playa Affiliates and subject to Playa Managements and the Playa Affiliates sole control. Executive shall deliver to Playa Management or the Playa Affiliates, as applicable, all documents and other tangibles (including diskettes and other storage media) containing the Proprietary Information (x) at any time upon request by the Playa Management Board or the applicable Playa Affiliate during his Employment Period and (y) immediately upon termination of the Employment Period.
